Bankruptcy News Articles and Updates:
Press Release: The latest Foreclosure Abuse Agreement between 14 of the largest banks and various government
agencies was designed to end the Government review of robo-signing, bad mortgage fees and accounting and other bad
acts that may have lead to foreclosure for people that should have been granted a modification or some other assistance.
The new settlement has not yet been finalized but is designed to help current and past mortgage holders with new
modifications, cash payments,  principal reductions of other assistance.  The oversight committee will create various
categories of people that qualify for the assistance and carry out implementation of the settlement over the next year as a
the details of the settlement are finalized.  As details are released we will create a new area of the web page to help
people navigate the settlement and to determine if their mortgage qualifies for assistance.

As part of this agreement Bank of America BOA will transfer more the servicing of more than $250,000,000,000 worth of
mortgages to nationstar and other mortgage servicers.  This could delay some short sales and frustrate work already done
by many on modifications. Ultimately this could prolong the mortgage crises by taking a company that finally has a system
down and overwhelming new companies with a tremendous amount of work.  The counter action that we must take is to be
diligent with each of our short sale and mortgage modification files.  Please contact us to see how this may impact your
distresses property case.

Press Release:  Marshal Watson, the head of one of Florida's largest foreclosure mills has agreed to a 91 day suspension
over the robo-signing debacle. The deal made with the Florida Bar Association over Watson's failure to supervise the
associates and staff handling many of the foreclosure cases must still be approved by the Florida Supreme Court, but
could have an impact on a number of foreclosure cases.  Many of these cases may be transferred to other firms, or
Marshall Watson, P.A. may spilt up and the cases may be taken with associates eager to start their own firms. If this is the
case the new firms may want to work quickly to show that they can improve service and maintain the bank clients after
Watson is reinstated. We cannot stress the importance of having each document received in your foreclosure case
reviewed by and attorney.  To discuss your mortgage, short sale or foreclosure please contact us for a free consultation.

PRESS RELEASE:  The Federal Housing Finance Agency Has decided that it does not have the authority to approve
mortgage modifications with principal reduction.  We can still help you attempt to convince your bank to reduce principal or
do a short sale, but Frannie Mae, and Freddie Mac will not consider reducing principal on your property while you keep the
property.

Bankruptcy Chapter 7 v 13

Each Bankruptcy consists of the same basic tests:
Liquidation Analysis and the Means Test.  In either
bankruptcy you must first perform a
liquidation analysis to
determine if you have assets above the
exemption level,
or the amount that you are allowed to keep.  If you have
assets above the exemption amount, you may either
surrender them or pay their value over time.  If you need
only a few months to pay a chapter 7 bankruptcy may
work. If you need more time a chapter 13 bankruptcy may
give you up to 60 months.

The means test is a test of average income. If your
household income exceeds the mean or average for your
area you may be considered to have discretionary income
and may be required to turn over the excess or
discretionary income over as much as 60 months in a
chapter 13 bankruptcy. If you do not have discretionary
income, by the Bankruptcy Means Test, and not in reality,
you may file either a chapter 7 or 13.  Note that there are
very intricate details to review in determining what type of
bankruptcy to file or even if you should file. Please

Sinkhole Insurance Claims

Tampa Sinkhole Lawyers at the Galewski Law Group, P.A.
use their long history in real estate and insurance claims to
protect your home or investment property against sink hole
damage.

Sinkhole claims are unique in the insurance claim industry,
because the insurance industry has lobbied for so many
years to exclude them from policies. Truth is even if your
insurance policy specifically excludes sinkhole claims, you
may have a right to have the company repair your home or
pay off your mortgage.

Sinkhole or settlement claims can impact your home,
business or investment home. Even a tenant in a
commercial building or rental home may have a claim
against the insurance company if there is settlement or
other damage caused by a sinkhole.

Sinkholes may present themselves as snake lines through
cinder blocks, foundation or wall cracks, driveway cracks,
depressions in land or other marks on a building.

The cost of a sinkhole claim may be in the tens of
thousands or more.  We will typically front these costs for
you and because of the cost we typically take these cases
on a contingency and do not get paid unless we win.
